Terms of Service

1. Introduction and Acceptance

Welcome to Elev-Aura, a holistic coaching application dedicated to overall well-being and health.

These Terms of Service (hereinafter "Terms") govern the access and use of the Elev-Aura application (hereinafter "the Application") provided by Stéphane Dekegel (hereinafter "we", "our").

By creating an account and using the Application, you unconditionally accept these Terms. If you do not accept these terms, please do not use the Application.

2. Description of Services

Elev-Aura is a holistic coaching platform offering personalized support through five complementary modules:

  • **Sport**: Training programs adapted to your level and goals
  • **Nutrition**: Nutritional advice and personalized meal plans
  • **Mindset**: Mental support and personal development
  • **Lifestyle**: Tips for a balanced and healthy lifestyle
  • **Menstrual Cycle**: Optional module — Tracking and support adapted to different cycle phases, only activated if the user chooses to use it

The Application offers educational content, personalized plans, progress tracking, and recommendations adapted to your profile.

Elev-Aura is an automated system. Plans, recommendations and adjustments are generated by artificial intelligence algorithms based on data provided by the user. No direct human intervention is guaranteed in the adaptation process, Horizon plan users benefit from priority access to customer support for any questions related to their usage.

3. User Account

3.1 Account Creation To access the services, you must create an account by providing accurate and up-to-date information. You agree to keep this information accurate.

3.2 Account Security You are responsible for the confidentiality of your login credentials and all activities performed from your account. You must notify us immediately of any unauthorized use of your account.

3.3 Responsibility You are solely responsible for your use of the Application and the information you share.

4. Subscriptions and Payments

4.1 Trial Period A free trial may be offered to discover the Application's features. Trial conditions (duration, access) are specified during registration.

4.2 Pricing Full access to services requires a paid subscription available in two plans: - Monthly subscription - Annual subscription

Current prices are displayed in the Application and on our website.

4.3 Automatic Renewal Unless canceled by you, your subscription automatically renews at the end of each period (monthly or annual) at the then-current rate.

4.4 Cancellation and Refund You may cancel your subscription at any time from your account settings or via your Apple/Google account. Cancellation takes effect at the end of the current subscription period. Cancellation terms via Apple or Google are subject to these platforms' own terms and conditions.

In accordance with applicable legislation on personalized digital content, no refund is possible after system activation. The Free plan allows you to discover the approach before any subscription.

5. Intellectual Property

All content on the Application (text, images, videos, programs, logos, trademarks) is protected by intellectual property rights and belongs to Stéphane Dekegel or its partners.

Any reproduction, representation, modification, or exploitation without express authorization is strictly prohibited and constitutes counterfeiting sanctioned by intellectual property law.

Access to the Application does not grant you any ownership rights to this content.

6. Acceptable Use

You agree to use the Application responsibly and in accordance with its intended purpose. It is prohibited to:

  • Use the Application for illegal or unauthorized purposes
  • Share your account with third parties
  • Attempt to circumvent security measures
  • Extract or copy content automatically
  • Distribute offensive, defamatory, or inappropriate content
  • Use the Application in a way that infringes the rights of third parties
  • Sell or resell access to the Application

Any breach of these rules may result in immediate suspension or termination of your account without refund.

7. Limitation of Liability

7.1 Important Medical Disclaimer **THE SERVICES PROVIDED BY ELEV-AURA ARE COACHING AND WELLNESS SERVICES, AND DO NOT IN ANY WAY CONSTITUTE MEDICAL ADVICE, DIAGNOSIS, OR MEDICAL TREATMENT.**

The Application does not replace medical consultation. Before starting any physical exercise program or changing your diet, especially if pregnant, suffering from a medical condition, taking medication, or in doubt, consult a qualified healthcare professional.

In case of health problems, medical emergency, or doubt, immediately contact a doctor or emergency services.

7.2 Service Availability We make every effort to ensure the availability and security of the Application. However, we do not guarantee that the Application will be error-free, bug-free, or interruption-free.

We reserve the right to temporarily suspend access to the Application for maintenance or updates.

7.3 Limitation of Liability To the extent permitted by law, we shall not be held liable for direct or indirect damages resulting from: - Use or inability to use the Application - Interpretation or application of advice provided - Results obtained or not obtained - Data loss

Elev-Aura does not guarantee any specific results. Progress depends on user commitment, consistency and many individual factors. Recommendations provided are indicative and do not constitute a guarantee of results.

8. Termination

8.1 Termination by User You may terminate your account at any time from your account settings or by contacting us at support@elev-aura.com.

8.2 Termination by Us We reserve the right to suspend or terminate your account in case of: - Violation of these Terms - Fraudulent or abusive use of the Application - Non-payment - Harmful behavior toward other users or our team

9. Modifications to Terms

We reserve the right to modify these Terms at any time. Modifications will take effect upon publication in the Application.

We will inform you of significant modifications by email or notification in the Application. Your continued use of the Application after modification constitutes acceptance of the new Terms.

10. Personal Data Protection

Elev-Aura collects and processes your personal data in accordance with the General Data Protection Regulation (GDPR — EU Regulation 2016/679).

To learn about the methods of collection, processing and storage of your data, as well as your rights (access, rectification, deletion, portability, objection), please consult our Privacy Policy accessible from the Application or at: /legal/privacy.

Some data provided by the user may be considered self-declared health data. Such data is processed exclusively within the scope of the Application's operation and in accordance with GDPR.

11. Applicable Law and Jurisdiction

These Terms are governed by Belgian law.

In case of dispute, we encourage you to contact us first to find an amicable solution. Failing agreement, any dispute relating to the interpretation or execution of these Terms shall be subject to the exclusive jurisdiction of competent courts in Belgium.
